• EVER AFTER DESIGN STUDIO TERMS AND CONDITIONS

  1. You agree that you are providing Ever After Design Studio with accurate credit card information at the time of submitting your online purchase order. You represent and warrant to Ever After Design Studio that your use of the submitted credit card is authorized and legal.

  2. Once you submit your order you have agreed to the pay the charges as they appear in your cart, including applicable shipping and sales tax.

  3. Ever After Design Studio reserves the right to deny the use of any promotional codes or coupons.

  4. All monogrammed items and custom orders are final sales. Please be sure to check your order carefully.

  5. Ever After Design Studio does not offer refunds to "personalized" hand painted wood products unless the error is made by Ever After Design Studio. Please be sure to double-check your order information before submitting. If there is an error with your order and the error was made on our part (i.e.: misspelled name or if item arrived damaged), a refund or replacement but not both will be granted for the particular item in question. We are not liable for mistakes made on the customers' part.

  6. Please be aware that our hand painted wood pieces are "handmade". Therefore the actual product may vary from what is pictured on our website. Even the color tint of your product may differ from a pictured item because all computer monitors display colors differently from one to another. If you know you will be ordering coordinating pieces at a later date, please let us know so that we can keep a record of the exact paints used in order to match future requests.

  7. Back ordered items are not in stock. By purchasing one of these items you are reserving one for yourself if and/or when they arrive at Ever After Design Studio. Ever After Design Studio makes an effort to give an estimated date of arrival, but makes no guarantee of the date of arrival and shipment. Additionally, Ever After Design Studio cannot guarantee that back ordered items will be re-stocked, however you will be notified if the items will not be re-stocked and will receive a refund of any payments made if this should occur.

  8. By submitting a back order you represent that the funds used as payment for these items are available and you authorize Ever After Design Studio to immediately submit a hold against these funds with your financial institution and then debit that amount at the time of shipment with any appropriate shipping charges and taxes.

  9. If a back order is submitted with an in-stock item and you wish to ship both items together, the in-stock item will be held and billed immediately with all appropriate shipping charges and taxes where applicable.

  10. Ever After Design Studio does not offer any price adjustments or changes in selected the billing method on prior purchases no matter the length of time between the submission of the order and contact with an Ever After Design Studio representative.

  11. If your order is rejected by your financial institution due to inaccurate credit card information, insufficient funds or any other reason, your individual financial institution may hold the funds. It is not Ever After Design Studio holding the funds and Ever After Design Studio is not responsible or able to release them. You must contact your financial institution directly.

  12. Ever After Design Studio's return policy for all printed designs is as follows: Once you have approved the proof and a paid order has been sent to print, no refunds or exchanges can be made. We urge you to double check all text and photo placement before approving the proofs for print. If you receive your order and for any reason are not satisfied, contact orders@everafterdesignstudio.com with a brief description of the issue and we will review the printed file. If a mistake is made by Ever After Design Studio, we will reprint your order at no cost to you. If a mistake is made by the customer and/or the proof was approved with a mistake, we will reprint your order with a 10% discount. Be advised that coloring and sizing of proofs viewed electronically varies depending upon your monitor's screen size and resolution.

  13. Ever After Design Studio's cancellation policy for all printed designs is as follows: If you cancel your order before approving your digital proof, you are not subject to any cancellation fees. After your digital proof has been approved you have one business day to cancel your order and you will be subject to a $20 cancellation fee which covers the time our designers applied to editing your images and/or customizing your design. Once your order has been sent to print, your order can not be canceled under any circumstances.

  14. Any item paid for with a store credit or gift certificate will receive the credited amount in the same form.

  15. When returning or exchanging an item, all shipping costs are the responsibility of the customer.

  16. Ever After Design Studio cannot be held responsible for returned items that do not arrive back to us. It is the responsibility of the customer to arrange for tracking, insurance and delivery confirmation. In the event that the return is not received or received in damaged condition, Ever After Design Studio will not issue a refund, credit or exchange. In order for the customer to recover any losses, it is his/her sole responsibility to file a claim with the chosen delivery service.

  17. If you receive a defective product from Ever After Design Studio, you must notify us in writing (via email) within two days of receiving the product to be eligible for a return.

  18. All merchandise sold at a 25% or greater discount is considered a clearance sale. This includes items on sale for this amount or items that are sold for a 25% or greater discount due to the use of special coupons and promotions. Returns of clearance items are only eligible for an exchange or store credit and must be postmarked within 3 business days of when you received the item, otherwise they cannot be returned.

  19. Items that are final sale will be listed as such in their description. Final sale items are not returnable or exchangeable.

  20. Returns that do not meet Ever After Design Studio's requirements will be sent back to the buyer at the buyer's expense.

  21. Ever After Design Studio reserves the right to deny a refund to any customer with excessive prior returns.

  22. Any package refused by a customer will be billed $10 upon receipt of Ever After Design Studio in addition to any other charges incurred by Ever After Design Studio as a result of the refusal.

  23. If a product is defective or damaged, it must be returned or exchanged within 30 days. Customer will pay for return shipping on authorized returns.

  24. All returns are only eligible with a valid Return Authorization number (RA#). In order to obtain an RA# the customer must call or email Ever After Design Studio. They must include the name on the order, date of purchase, as well as the reason for return or exchange. Once an RA# is issued, the customer must send back the item(s) approved for return/exchange in the permitted time period and the RA# must appear on the outside of the package.

  25. Any return or exchange without an RA# will be refused and returned to sender at the sender's expense. No exceptions will be made.

  26. In the event that the wrong RA# is provided by the customer or the return is opened by Ever After Design Studio, but does not meet the requirements it will either be shipped back at the customer's expense or a store credit will be issued (depending upon the return). This is at Ever After Design Studio?s discretion.

  27. Although Ever After Design Studio believes that it will have sufficient inventory to fill your orders, it is possible that certain products may be unavailable, from time to time. In the event an item you have ordered is unavailable, Ever After Design Studio will attempt to notify you and will fill the remainder of your order.

  28. Ever After Design Studio's online shopping services are provided on an "As Available" basis, and Ever After Design Studio does not provide any assurances of the availability or usability by you of the online shopping services.

  29. Ever After Design Studio uses a third-party delivery service and makes no guarantee regarding time or date that items are delivered.

  30. If you become aware of any unpaid sales taxes or other amounts with respect to any purchases, it is your responsibility to expeditiously report this to Ever After Design Studio and timely pay such taxes or amounts.

  31. Ever After Design Studio has the right to deny service to anyone in its sole and absolute discretion, with or without cause or reason.

  32. Ever After Design Studio shall not be liable to you for any interception of online communications, software or hardware problems (including without limitation viruses, loss of data, or compatibility conflicts), unauthorized use of your credit card, or other consequence beyond the reasonable control of Ever After Design Studio.

These Terms and Conditions and the order form, collectively constituting the sole and entire agreement between Ever After Design Studio and you regarding the online shopping services, are governed by laws of the State of New Jersey and any and all disputes arising thereunder shall be litigated, if at all, by a court of competent jurisdiction within the State of New Jersey.

  34. It is your responsibility to review the Terms and Conditions prior to submitting each order and Ever After Design Studio has no responsibility to notify you of any changes prior to effectiveness of the changes or otherwise.

  35. Ever After Design Studio reserves the right, with or without notice to you, to amend the Terms and Conditions for use and purchases regarding the online shopping services. Any amendments by Ever After Design Studio will be effective only as to orders you place subsequent to Ever After Design Studio.

  36. These Terms and Conditions, as amended from time to time, shall be the sole terms of the agreement between you and Ever After Design Studio regarding your online purchases. All statements otherwise made on the web site are intended only for your convenience.
